Navigating regulation changes regarding evidence of origin goods benefitting from UK free trade agreements

Businesses which trade overseas are being urge to ensure they understand a new regulatory change which has come into effect regarding errors around evidence of origin.

This in relation to trade deals with UK and Canada, UK and Republic of Turkey, UK and Iceland, Liechtenstein and Norway, UK and New Zealand, and countries covered by the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP)

If there is an error in the claimed origin of the goods, businesses will be required to inform their customers immediately, and failure to do so can result in penalties being issued by HMRC – the maximum penalty being £1,000.

Jamie Harper, Customs Broker at Independent Freight Solutions, said: “This is being introduced as there hasn’t previously been anything in legislation regarding this matter.

“It will only be a concern if you suddenly become aware that your goods are no longer of UK origin and your customer is claiming preference.

“It’s imperative for businesses involved in importing and exporting to affected territories to understand and comply with these regulations

“We are contacting our clients to ensure that they are aware that this is coming into play and we are able to provide help, advice and guidance on what to do next if they have any products which they think aren’t of UK origin.

“It is down to the business to ensure customers are aware if there has been a change in preference status of goods.

“By staying informed on the origin of goods and communicating effectively with customers, any HMRC penalties will be avoidable.

“The regulation outlines that notifications must be given in a specific manner, satisfying requirements regarding timing, form and content.”
